- It is important to take pictures immediately of the car, before it is repaired. If possible take pictures of the road conditions. Most people have cameras on their cell phones or other digital devices – they should use them. It is also important to take immediate pictures of any injuries, especially before they have healed. Bruises go away quickly, so take pictures of all injured areas immediately. If injuries persist, continue taking pictures, and make a note as to when these pictures were taken.
- Don’t rely on the police to obtain witness statements. Get the names, phone numbers, addresses, and general statements of any witnesses. Take notes of where they were and what they saw. This could prove invaluable if it becomes necessary to bring suit in court.
- It’s a good idea to keep a journal of your injuries, loss of work, and general symptoms. If you lose some days of work to go to the doctor, make a note of it. If you start feeling pain in a certain area of the body, make a note of it, along with the duration and intensity. Record when your symptoms come and go. Also record your mental state: if you are becoming depressed, can’t sleep, can’t engage in your favorite activities, etc. Remember that your spouse may have claims when you are injured, so record those activities that you used to do together that you can’t engage in anymore, or when your spouse has to go out of his or her way to help you. This log of your damages will be very useful in proving the extent of your injuries in court.
